Feiner sets petition hearing date; unlawfully extends objection period

Albany Update

It is our understanding that bill S05793/A7997 remains under discussion by legislators, who have heard our concerns. We’d like to thank everyone who called and e-mailed—it made a difference! At this juncture, we are watching closely but giving our representatives the opportunity to deliberate. If we are made aware of any movement related to the bill, we will send out a notice.

Petition Update

The next step in the petition process is a hearing, held by the Supervisor, on the legal sufficiency of the petition. Last week, we asked the Town for the date of the hearing and today, June 10th, the Town gave us notice that the petition hearing will be held at Town Hall on July 16th. However, as we told the Supervisor earlier today in an email before he published the notice, state law does not permit the hearing to be held more than 30 days from when the date is announced. By ignoring us and issuing the notice today anyway, the Supervisor has now given objectors 40 days or 33% more time then the law allows. We hope the Supervisor will correct the error that he created so that we can proceed in accordance with the law.

In addition to granting more time to the objectors, the Supervisor also highlighted his concerns with the petition in the press even though his role is in this process is to rule on the objections, not raise them himself. Nevertheless, while we believe the community remains in favor of having a vote to decide this issue, we also want to emphasize that anyone who wishes to remove his or her name from the petition is still free to do so. If you wish to have your name removed from the second petition for incorporation, please e-mail or call us (no questions asked).

Also, please also contact us if you didn’t sign but would like to indicate support for a referendum on whether Edgemont should become Greenburgh’s 7th village.
